ULUC Updates

Overview of Code Amendments

Read and comment on the draft amendments in Encode. Public comment will close at 5 p.m. Wednesday, April 30.

The City of Littleton is seeking to undertake several Code amendments for 2025. Many of these amendments are required according to state legislation that was passed in 2024. Please note that, aside from Accessory Dwelling Units (ADUs) and Parking Minimums, there are no other updates related to housing at this time. These amendments related to legislative requirements will be presented on 5/12 at Planning Commission.

 Those amendments include:

  • ADUs - The state is requiring that municipalities across the state adopt regulations to permit Accessory Dwelling Units (ADUs) in all zone districts where single-family detached homes are permitted. These ADUs are to be regulated similarly to single-family detached homes and to reduce the barriers to construct these housing types. These changes can be found in 10-1-1.7.
  • Minimum Parking - The state has directed municipalities to remove minimum parking requirements for multifamily residential (defined in the ULUC as 5 or more units), as well as mixed use residential and adaptive reuse residential projects, that fall within the Applicable Transit Area Map, published by DOLA. This bill does not prohibit the enforcement of parking maximums, which would prevent the over utilization of parking for a project. At the March 11 study session, council had directed planning staff to expand the parking exemption to all residential projects that fall within the Applicable Transit Area Map. These changes can be found in Sections 10-1-3.7.A and 10-1-3.7.B.
  • Nonfunctional Turf - The state has prohibited the installation of turf, artificial turf and invasive plant species on any nonresidential project. This text amendment will not impact any residential property and does not require the removal of any nonfunctional turf, but prohibits new installation. These changes can be found in 10-1-3.6.A.
  • Occupancy limits - The state has prohibited municipalities from limiting household occupancy according to familial relation. The City of Littleton had already removed this restriction in 2021, with the adoption of the ULUC, but has located one provision in the Code which restricts the occupancy of mobile homes according to familial relation. This bill does not prohibit limiting occupancy according to health and safety standards. These changes can be found in 10-4-3.2.G.

Process Improvement Updates

In addition to the legislative updates, staff is also undertaking two other updates, as they relate to process improvement:

  • Platting - City staff has identified several opportunities to streamline the platting process, in order to reduce the review process for applicants. These changes can be found in 10-6-1.2, 10-6-2.2, 10-9-7.1 and 10-9-7.3.
  • Notices of Mailing - City staff is exploring the option of amending the requirement that staff sends mailing notices for neighborhood meetings, allowing flexibility for applicants to mail notices. These changes can be found in 10-9-3.5 and 10-9-3.6.

The draft amendments for public comment will be made available on April 14 and will close April 30. Those redline edits will be made available on Encode.
