He said the store manager told him his dog wasn't allowed inside and to take down the hood of his sweatshirt.Montoya said the manager had no right to give him those demands and he refused to oblige.That's when Espanola police Officer Danny Pacheco got involved. According to Montoya, the officer was aggressive and he felt threatened. He said he was so afraid he called 911. As he was on the phone Pacheco used a Taser on Montoya, hitting him in the back -- causing him to drop the puppy, which fell to the ground."He was bullying me," Montoya explained. "He's a peace officer, I thought. I didn't think he should be out there making chaos."But according to the police report, Montoya was yelling and disobeying the officer's commands and that's why he got Tased. Montoya was arrested and charged with disorderly conduct, but a prosecutor dropped those charges.The Espanola police chief said city officials are now looking into both sides of the story to see if Pacheco acted too aggressively or if Montoya was truly a threat.
