If an individual is suspected of DUI/DWI, the state of Delaware requires a blood or breath test to determine the person’s blood alcohol content (BAC). Turning down the test can result in one year of license revocation for a person who is 21 years old or older and two years of license revocation for an individual who is under 21 years of age. The person suspected of intoxication may be tested for the bodily presence of alcohol and drugs, both prescription and illegal. A chemical test that shows the presence of a BAC greater than .05% is sufficient for an arrest, and a BAC of .08% or higher is enough for a DUI/DWI conviction.
