Oviedo police said Sean Gilhuly, 30, was off-duty and not operating a department vehicle at the time of his arrest Sunday afternoon.

Police responded to a call for a possibly intoxicated driver who sat through two traffic cycles on Mitchell Hammock Road at about 5:47 p.m. When the first officer responded, Gilhuly was still parked in a travel lane, causing other drivers to move around him, according to his arrest affidavit.

Gilhuly was alone in the car and "laying in plain view in the front passenger seat of the vehicle was an open container of Peach Ciroc liquor," the arrest report said.
Police said he had glassy, watery, bloodshot eyes, strong alcohol odor, slurred halting speech and was unable to stand on his own without leaning against his vehicle.

"Another officer had to stand next to Sean and at times hold him up to prevent him from falling to the ground," the report said.

Gilhuly was taken to a nearby parking lot and questioned.

"Sean told me he was a police officer with Orlando Police Department. I asked him where his credentials where (sic). He was unable to answer my question," the report said.

According to police, Gilhuly denied being under the influence of drugs or alcohol and refused a sobriety test.

"He said no and repeatedly told me 'Don't (expletive) me over,'" the report said.

His supervisor was called to the scene and retrieved his vehicle, and Gilhuly was taken to the Seminole County Jail, where a nurse was unable to clear him medically because of his "apparent extreme intoxication."

When officers attempted to take him to the hospital, he became uncooperative, kicking out the rear passenger-side window of a cruiser and then screaming and yelling obscenities at the hospital, police said.

He was later booked in jail and held on $550 bond.

Gilhuly has been relieved of duty with pay pending the outcome of an internal investigation. He has been with the patrol division of the Orlando Police Department since September 2011.

Newly released records show that in 2011 Gilhuly was suspended for eight hours after accidentally discharging his gun during training. No one was hurt during the incident. Gilhuly was also reprimanded for a 2012 traffic accident. No one was hurt during the crash.
