What's the Difference Between A Trust and A Will?

  • By By J Chad Gauntt
  • 05 Oct, 2019
When it comes to planning for your future, most people never assume it is for a future without you in it. Having arrangements in place that help control your assets from beyond your gravestone, is a grim thought, but can be extremely beneficial to your grieving loved ones. Many assume that having a will can take care of everything, and while most do, including a living trust can help to create a complete estate plan.

There are many differences between a living trust and a will, the most important one being a will only goes into effect after one dies, while a living trust will go into effect as soon as it is created. The will is arranged so that after one dies it helps to sort out who receives certain properties (such as land, money, estates and possessions) and appoints a legal representative to carry out said will. This becomes a legally enforceable document that specifically lists how you would like your assets distributed and affairs handled after you die. If for some reason, you die while having underage children at home, a will can be created to appoint guardians for minors. If no will was created before your passing, closest relatives may have to seek counsel with a court to obtain guardianship for children, and keep in mind that the judge may appoint a guardian who you may not have entrusted with your children. Some parents will set up wills when they are expecting in case of an untimely death.

It is also important to note that a will can also act to disinherit a child or spouse, depending on state laws. Children, whether biological or adopted, have a legal right to inherit, but a will enables you to disinherit children or other natural heirs in your will.

When drawing up a will, it is important to seek legal counsel, such as the Woodlands estate planning attorney. There are issues when creating a will that can be avoided beforehand when properly assisted with an attorney.

A living trust is another form of estate transfer, however the main difference is a living trust can be conducted while one is still alive. It allows for a third party, known as a trustee (typically a person or institution, such as a bank or trust company) to hold legal titles to properties for another individual known as a beneficiary. Beneficiaries may receive principal, income, or both from the trust.

Unlike a will, trusts are conducted outside of probate court, and their distribution is controlled solely by the trustee. This also means that without costly court and attorney fees, surviving relatives will not have to pay out of pocket or be tied up in court. Trusts will also remain private and not become public record, whereas a probated will does.

As a resident of Texas, you may find yourself needing an attorney for various reasons. However, when it comes to appellate cases, it is crucial to hire a qualified appellate lawyer who can represent your case effectively. An appellate lawyer specializes in handling appeals from lower courts and has extensive knowledge and experience with the legal system's rules and procedures. Here are some reasons why hiring an appellate lawyer in Texas is essential.

The Role of an Appellate Lawyer

The role of an appellate lawyer is different from that of a trial attorney. While trial attorneys focus on presenting evidence and arguing their client's case before a jury or judge, appellate lawyers handle cases after they have been tried at the trial court level. Appellate lawyers work on appeals filed by clients seeking relief from judgments or orders issued by lower courts. They review transcripts, research legal issues raised during the trial, draft briefs outlining arguments supporting their client's position, and present oral arguments before higher courts. Moreover, these lawyers understand how to navigate complex procedural rules governing appeals and possess excellent writing skills necessary for drafting compelling briefs that persuade judges to rule favorably for their clients.

The Benefits of Hiring an Appellate Lawyer

When you hire an experienced appellate lawyer, you benefit from having someone who understands what it takes to win on appeal. These professionals know how to identify potential errors made during trials that could be grounds for appeal while also recognizing opportunities presented by favorable rulings made at the lower court level. Furthermore, they can help ensure that your rights are protected throughout every stage of litigation while providing valuable insights into strategies used by opposing counsel as well as judges hearing your case on appeal.

Qualities to Look for in a Qualified Appellate Lawyer

When looking for an appellate lawyer, several qualities are necessary to ensure that you receive the best representation possible. Here are some things to keep in mind when choosing a qualified appellate lawyer:

Experience and Knowledge -  It is essential to choose an appellate lawyer with experience handling appeals similar to yours. They should have extensive knowledge of the legal system's rules and procedures, as well as relevant case law governing your particular issue.
Excellent Writing Skills -  Appellate lawyers must possess excellent writing skills necessary for drafting persuasive briefs that can convince judges to rule favorably on their client's behalf.
Strong Oral Advocacy Skills -  An effective appellate attorney should also have strong oral advocacy skills needed for presenting compelling arguments before higher courts during oral arguments.

What is Medical Malpractice and How Does it Happen?

Medical malpractice occurs when a healthcare professional or medical facility fails to provide the standard level of care that a patient deserves. This negligence can result in serious injuries, illnesses, or even death. In Texas, medical malpractice is unfortunately common, with thousands of cases reported each year. There are many ways that medical malpractice can occur. Some examples include: misdiagnosis or delayed diagnosis, surgical errors, medication errors, birth injuries, and failure to properly monitor patients during and after procedures. It's important to note that not all negative outcomes from medical treatment constitute medical malpractice. However, if you believe your healthcare provider was negligent in their actions which led to harm being caused then you may have grounds for a lawsuit.

The Devastating Consequences of Medical Malpractice

The consequences of medical malpractice can be devastating for both the patient and their loved ones. Victims may suffer physical pain and emotional trauma as well as financial burden due to additional treatments required for recovery from the injury caused by the negligence. In addition to these personal impacts there are also broader societal implications associated with such incidents, including further distrust towards health care providers leading some people not seeking necessary treatment altogether out of fear they will become victims themselves. The effects on families who lose loved ones due to wrongful deaths resulting from this type of negligence cannot be overstated either - it can leave them feeling angry at those responsible but helpless knowing no amount of legal action will bring back what has been lost.

How a Medical Malpractice Attorney Can Help You

If you believe you have been harmed by an act of medical malpractice, then it's essential that you seek legal representation from an experienced attorney. A medical malpractice attorney can help you navigate the complex legal process and fight for your rights as a victim. An experienced attorney will be able to investigate your case, gather evidence, and build a strong argument on your behalf. They can also negotiate with insurance companies or healthcare providers to ensure that you receive fair compensation for any damages incurred due to the negligence of others.

What to Look for in a Medical Malpractice Attorney

When choosing an attorney to represent you in a medical malpractice case, it's important to look for someone who has experience handling these types of cases specifically. You want an attorney who understands the complexities involved in proving negligence by healthcare professionals and is familiar with the laws regarding such incidents. Additionally, make sure that they have good communication skills so that they are able to keep you informed throughout the entire process. It's also important that they are empathetic towards their clients which ensures emotional support during this difficult time. Finally, consider looking at past client reviews online before making any decisions about hiring representation - this will give insight into how well-regarded they are by those who have worked with them previously.  At G auntt, Koen, Binney & Kidd, LLP they practice what we refer to as “relationship lawyering.”  They take the time to get to know you and to learn about your needs.

When it comes to truck accidents, Texas is no stranger. With a population of over two million people and an abundance of highways and interstates crisscrossing through the city, there are plenty of opportunities for collisions involving large trucks to occur. If you’ve been injured in a truck accident in The Woodlands, Dallas, or surrounding area, it’s important to find an experienced personal injury attorney who can help you get the compensation you deserve. In this article we will cover types of truck accidents in Texas, what to look for when choosing a personal injury attorney in Texas, common mistakes to avoid when selecting your lawyer and how to find the right one for your case.

Types of Truck Accidents

Truck accidents can come about as a result of many different factors including driver fatigue or negligence; improper maintenance or loading; hazardous road conditions; defective parts; and more. Some common types of truck accidents that occur on Texas roads include: Jackknife Accidents - These involve a semi-truck skidding across multiple lanes due to sudden braking or swerving maneuvers caused by distracted driving or poor weather conditions. Rear-End Collisions - This type often occurs when drivers tailgate each other too closely which results in one vehicle hitting another from behind due to an inadequate stopping distance. Rollover Accidents - When cargo isn't properly secured inside the trailer during transport it can cause unbalanced weight distribution leading up to these dangerous crashes where trucks flip onto their sides. Underride/Override Accidents – These involve smaller vehicles being crushed underneath larger ones because they couldn't stop quickly enough before impact occurred (underride) or if they were hit from behind while stopped at traffic lights (override).

What To Look For In A Personal Injury Attorney In Texas

When searching for an experienced personal injury attorney who specializes in truck accident cases in Texas make sure that they have:

Years Of Experience Handling Similar Cases – Your legal representative should be well versed with local laws related specifically towards motor vehicle collisions so that they know all the possible angles from which to approach your case effectively.
-Proven Track Record Of Successful Outcomes – It's always best practice to do some research into past outcomes achieved by any potential lawyers prior to making a final decision on who will represent you in court.
-Access Resources And Expertise Needed To Win A Case – An effective strategy requires access to resources such as expert witnesses testimony, medical records, analysis, etc.
-Open Lines Of Communication Throughout The Process – Having open lines of communication between you and your lawyer is essential throughout the process to ensure the goals and objectives are discussed clearly and understood by both parties involved in order to secure the desired outcome in favor of the client.

Common Mistakes To Avoid When Choosing A Personal Injury Attorney

It's easy to fall prey to bad advice given by the wrong sources of information such as: online forums, social media outlets, etc..  Instead follow some of the pointers below:

- Don’t Choose Based On Price Alone – While cost is a factor to consider don't let price alone determine your decision making process. Remember cheaper doesn't always mean better.
- Don’t Sign Any Agreements Without Reading Them Carefully First– Before signing off on anything double check the contents thoroughly. Understand the implications fully and read the terms and conditions in fine print carefully to make sure you aren't getting taken advantage of.
- Don’t Assume All Attorneys Are Created Equal– Each individual is unique in their own set skill set and may specialize in certain areas of law that others might offer comprehensive services encompassing a wide range of topics.    â€‹

How To Find The Right Attorney

Now that know what good qualities to look for in a lawyer it's time to actually go find the right attorney.   Look no further..contact  Gauntt, Koen, Binney & Kidd, LLP   at  (281) 367-6555 and set up your free consultation today!

Explain the Importance of Having a Trust in Estate Planning

When it comes to estate planning, having a trust is essential. A trust allows you to transfer your assets to designated beneficiaries after you pass away. Without one, your assets will be subject to probate court proceedings which can take months or even years before they are distributed according to your wishes. With a trust, however, the process is much simpler and faster because all of the paperwork has already been taken care of beforehand. In addition, trusts provide more privacy for your family since there’s no need for public disclosure during probate proceedings.

Discuss the Benefits of Having a Trust - Such as Avoiding Probate

Having a trust means that you don’t have to worry about going through probate court proceedings when transferring your assets after death. This saves time and money since there are no legal fees associated with setting up or administering a trust like there would be with probate court proceedings. Additionally, trusts offer more control over how and when assets are transferred since they can be set up ahead of time according to specific instructions laid out by the grantor (the person creating the trust). This ensures that their wishes will be followed even if they’re not around anymore when it comes time for distribution of their assets. Trusts also help avoid costly taxes on large estates because they allow them to be divided into smaller pieces so each beneficiary only receives what was intended for them without any extra tax burden from inheritance laws. Finally, trusts can protect vulnerable members of society such as children or those with special needs who may not understand complex financial matters by providing them with access only under certain circumstances specified by their guardian or trustee rather than giving them full access immediately upon inheriting an estate from someone else.

Summarize The Steps To Take To Set Up A Trust With An Estate Planning Attorney

Setting up a trust requires careful consideration but working with an experienced estate planning attorney makes it easier than ever before! Here are some steps you should take when setting up a trust:
