Answer given by President Juncker on behalf of the Commission

European Union law will cease to apply to the United Kingdom as of the withdrawal date. This includes overseas countries and territories having special relations with the United Kingdom as well as European territories for whose external relations the United Kingdom is responsible (by virtue of Article 355 of the Treaty on the Functioning of the European Union).

Gibraltar is one of these territories and therefore bound to leave the European Union together with the United Kingdom. What is referred to in the guidelines of the European Council of 29 April 2017 the Honourable Member mentions does not relate to the withdrawal negotiations with the United Kingdom, but to the future relationship between the EU and the United Kingdom.
