Jury Awards $72 Million in J&J Talcum Powder Ovarian Cancer Case

J&J Ordered to pay $72 Milllion in Damages to Victim’s Family

Talcum Powder Ovarian Cancer

A Missouri State jury recently awarded $72 million in damages to the family of plaintiff Jacqueline Fox, who lost her life to ovarian cancer after using Johnson & Johnson’s Baby Power and Shower to Shower for several decades.

Court records and family’s lawyers reported that the jury’s verdict on February 22, 2016 awarded $10 million to the victim’s family for actual damages and $62 million for punitive damages.

The lawyers said that this is the first verdict by a U.S. jury to award damages over the Johnson & Johnson talcum powder ovarian cancer claims.

This won’t be the last claim a U.S. jury will hear. Johnson & Johnson faces hundreds of lawsuits claiming the company failed to warn consumers about its talc-based products causing cancer.

The family’s lawyer said that the jurors in the circuit court of St. Louis found Johnson & Johnson liable for fraud, negligence, and conspiracy. The trial lasted three-weeks and was followed by a four hour jury deliberation.

A lawyer for the victim’s family said in a conference call that Johnson & Johnson, “knew as far back as the 1980’s of the risk,” but rather than disclosing the risk the company decided to continue “lying to the public, lying to the regulatory agencies.”

A spokeswoman for Johnson & Johnson said, “We have no higher responsibility than the health and safety of consumers, and we are disappointed with the outcome of the trial. We sympathize with the plaintiff’s family but firmly believe the safety of cosmetic talc is supported by decades of scientific evidence.”
