Handgun Permits - As enacted, creates a lifetime handgun carry permit which entitles the permit holder to carry any handgun that the permit holder legally owns or possesses without expiration; sets the application fee for a lifetime handgun carry permit at $500 and establishes other requirements for obtaining and maintaining the permit. - Amends TCA Section 39-17-1351.

Calculating the present value of the estimated net additional cashflow generated by the individuals choosing a $500 lifetime permit yields a net present value benefit of $14,500,000.


    Bill Summary

    Under present law, with certain exceptions, a handgun carry permit is valid for four years.

    This bill provides for a lifetime permit. Under this bill, any resident of Tennessee who is a United States citizen or lawful permanent resident, who is at least 21 years of age, may apply to the department of safety for a lifetime handgun carry permit. If the applicant is not prohibited from purchasing or possessing a firearm in this state pursuant to state or federal law, and the applicant otherwise meets all of the requirements for a permit, the department will issue a permit to the applicant.

    The department will charge an application and processing fee of $500 for a lifetime handgun carry permit. The application process will otherwise be the same as the application process for a handgun carry permit as set out in present law. A lifetime handgun carry permit will not expire and will continue to be valid for the life of the permit holder unless the permit holder no longer meets the requirements for a permit. A lifetime handgun carry permit will not be subject to renewal. Generally under present law, an applicant must apply to renew a permit and as part of the renewal process must certify that the applicant still satisfies all the eligibility requirements.

    ON APRIL 13, 2015, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 745, AS AMENDED.

    AMENDMENT #1 requires that any funds raised by the fee that are not used for processing applications and issuing permits are to be retained by the department to fund any system modifications required to create a lifetime handgun carry permit and monitor the eligibility of lifetime handgun carry permit holders.

    This amendment requires the department to conduct, every five years after issuance of a lifetime handgun carry permit, a criminal history record check in the same manner as required for permit renewals. The department must suspend or revoke a permit of any person the department discovers no longer satisfies the requirements for a handgun carry permit.

    This amendment requires a lifetime handgun carry permit holder whose permit is suspended or revoked to deliver the permit to the department within 30 days of the suspension or revocation. If the permit is not timely received, the department must send notice to the permit holder that:

    (1) The permit holder has 30 days from the date of the notice to deliver the permit to the department; and
    (2) If the permit fails to deliver the permit within 30 days of the notice, the department will suspend the permit holder's driver license.
