BROCTON, N.Y. (WIVB) — A man with a history of drunk driving found himself charged with it again over the weekend.
New York State Police say on Friday night they responded to a vehicle which had crashed off the road on Ellicott Road. They say when they got to the scene the driver needed help leaving the car and had an open can of Busch Light in the cup holder.
When they found the open can of beer, Troopers arrested James Schroeder Jr, 47, who they say had slurred speech, droopy eyelids and difficulty standing up straight. He refused to take the field sobriety test, and refused to take a breathalyzer test.
Troopers say Schroeder had two DWI convictions in the past 10 years, which resulted in the suspension of his license. Troopers charged him with felony DWI, refusal to take a breath test, using a vehicle without an interlock device, first degree aggravated unlicensed operation of a motor vehicle, drinking alcohol in a motor vehicle and speeding.
Schroeder is currently in the Chautauqua County Jail in lieu of $2,000 cash bail. He’ll be in court next on March 10.
