FAIRLAWN, Ohio — An off-duty Fairlawn police officer has been charged after allegedly leading police on a chase.

It happened on Saturday, May 7, just before 2 a.m. Police say they were involved in a pursuit which started after they saw a vehicle speeding on W. Market St. The vehicle was clocked going 77mph in a 35mph zone. The officer activated his overhead lights and siren to try and stop the driver. The driver didn’t stop, and continued westbound on W. Market St. before turning northbound on Ghent Rd. Another officer joined the pursuit, which eventually continued on Smith Rd.

Police say the driver turned into the residential neighborhood of Lake in the Woods in Akron, and then into a private driveway.

When the passenger put down his window, he was immediately identified as an off-duty Fairlawn police officer. The driver was also identified as an off-duty Fairlawn officer. They were allowed to leave at that time.

The facts were presented to the Akron Prosecutor’s Office who authorized charges of failure to comply with order or signal of police officer, and reckless operation and speed for the driver, identified as Officer Justin Herstich, a 9-year veteran.

No charges were filed against the passenger.

Administrative action is being reviewed.
