Former Jefferson Parish Sheriff's Office deputy Brian Martin, 38, was fired and arrested after authorities say he agreed to not to take a wanted woman to jail if she had sex with him.

Jefferson Parish Sheriff's Office officials fired a deputy and arrested him after they say he allowed a wanted woman to avoid jail in exchange for sex. Brian Martin, 38, of Hammond, was terminated Monday (Dec. 8) and booked into the Jefferson Parish Correctional Center in Gretna on a charge of malfeasance in office, said Col. John Fortunato, spokesman for the department.

Martin confessed to having sex with the unidentified woman, who reported the encounter to Sheriff's Office officials on Saturday (Dec. 6), according to an arrest report.

Martin was assigned to the department's 1st Patrol Division in East Jefferson. On Oct. 8, he went to a residence in the 3500 block of Sam Lenox Street in Old Jefferson to handle a complaint from a woman about the theft of some property from a car, Fortunato said.

While taking down information for the incident report, Martin learned the woman had two outstanding Jefferson Parish attachments and a warrant, Fortunato said.

That's when Martin worked out a deal: have sex and avoid jail.

The woman agreed, and the two consummated the deal. They went their separate ways until Saturday when the woman contacted the department to report another theft, Fortunato said.

A different deputy responded and told the woman about the attachments and warrant, Fortunato. The woman then informed the deputy of her previous arrangement with his colleague. But no similar terms were struck. The deputy arrested the woman and informed supervisors about the allegation.

Sheriff's Office officials interviewed Martin on Monday afternoon and arrested him after he admitted having sex with the woman, the arrest report said. He was released from the correctional center the same day on a $5,000 bond.
