Do you accept the Campus Recreation Climbing Wall Release of Liability, Assumption of Risk and Indemnification Agreement? *
I, ________________________________________ (“Participant” or “I”), understand and agree that before I will use or visit the climbing wall at The University of North Carolina at Chapel Hill (“University”) I must successfully complete a facility orientation and an instructional class provided by the University that includes an introduction to safety issues and procedures, instruction on the care and use of equipment, Auto Belays, knot tying, belaying techniques, climbing techniques, and proper climbing wall etiquette and pass a University belay test demonstrating competence in the above listed skills.   As part of the consideration for my participating in and/or visiting the climbing wall activities offered by the Campus Recreation department of the University, I hereby release, hold harmless, and forever discharge the University, including its trustees, officers, employees and agents, from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, property damage, or personal injury, including death, that may be sustained by me or to any property belonging to me while participating in the climbing wall instructional class whether resulting from the negligence of the University or otherwise.  I understand that the risks associated with climbing wall activities as a participant or visitor include, but are not limited to: 1. Injury, disability or death resulting from falling from the climbing wall and impacting against wall surfaces or projections or the gymnasium floor; 2. Injury, disability or death resulting from rope abrasion, entanglement or other activities involving ropes on or near the climbing wall such as climbing, belaying, rappelling, lowering on rope, rescue systems, and other rope techniques; 3. Injury, disability or death resulting from contact with falling climbers or dropped objects; 4. Cuts and abrasions resulting from skin contact with the climbing wall; 5. Musculoskeletal injuries resulting from the physical stress of climbing and/or belaying;  6. Injury, disability or death resulting from failure of ropes, slings, harnesses, climbing hardware, anchor points, other climbing equipment or any part of the climbing wall; and 7. Injury, disability or death resulting from the failure of Participant or others associated with the climbing wall experience to follow proper safety procedures and precautions.   I understand and acknowledge that the University strongly encourages climbers engaged in unroped activities, such as traversing and bouldering, to use spotters.   I acknowledge, assume, and accept all responsibility for the proper selection, use, care, maintenance, inspection, and storage of personal climbing equipment.  I also agree that any personal equipment used must be manufactured specifically for climbing use and used in accordance with the original equipment manufacturer’s instructions.  I understand that the Climbing Wall Staff reserve the right to inspect and/or refuse use of my personal equipment at any time.  I understand and acknowledge that the University strongly recommends and encourages all participants engaged in roped climbing activities to wear safety helmets.  I am aware a protective helmet could prevent permanent brain damage or other injury in the event of an accident.  I am also aware it is my responsibility to provide and use a protective helmet according to the manufacturer’s specifications while participating in climbing activities.  I understand and acknowledge that the University recommends that I have a physical examination and consult with my physician about physical activity and exercise before participating in this activity, especially if I have any physical conditions that may be harmfully affected by the activities involved, including, but not limited to, heart, circulatory, respiratory, or musculoskeletal conditions or pregnancy.  I represent to the University that I have either (a) had a physical examination by a physician and been given my physician’s permission to participate in climbing wall activities, or (b) that I have decided to participate in this activity without the approval of my physician despite my acknowledgment and assumption of the risks associated with it.  I acknowledge that my participation in the climbing wall activity is wholly voluntary.  Participation in the climbing wall activity is not required as part of my University academic program or University employment. I voluntarily assume full responsibility for any risk of loss, damage, or personal injury, including death, and for any property damage that may be sustained by me as a result of participation in this activity.  In the event of illness or injury, I hereby authorize the program director or instructors or other agents to obtain emergency or other medical treatment for me as deemed necessary, including administration of anesthetic or other medication and surgery, and I hereby assume the cost of such treatment. I understand that this authorization permits University personnel to consent on by behalf to the diagnosis, treatment, or hospital care which, in the best judgment of a licensed physician, is deemed advisable.   I agree to indemnity and hold harmless the University, including its trustees, officers, employees and agents, from any loss, liability, damage or cost, including court costs and attorney’s fees that it may incur due to my acts and omissions associated with this activity, except that caused by the negligence of the University, its employees or agents.  I agree to abide by, and to help enforce, the following University Campus Recreation climbing wall safety policies: 1.   All Participants must submit their UNC One Card in order to gain access to the climbing wall.   2. Participants must pass a belay proficiency test and receive a belay certification card from the University before belaying other climbers. 3.   All climbing above the bouldering line must be belayed. 4.   Participants climbing above the bouldering line must be roped and belayed through a belay plate or tuber. Roped climbers and belayers must wear harnesses. 5.   Participants must report to a Campus Recreation employee any observations of other climbing wall participants engaging in climbing wall practices that are not in accordance with these safety policies or otherwise appear unsafe. 6. Participants must immediately report all accidents or equipment damage to a Campus Recreation employee. I understand that I will not be charged for damage to rental equipment.    I agree to follow and abide by all facility rules as posted at each climbing facility.  I understand that Campus Recreation reserves the right to withdraw an individual’s belay certification card, temporarily or permanently for failure to follow these safety policies, or for any conduct that Campus Recreation employees deem as unsafe.  This Release shall be governed by and interpreted in accordance with the laws of the State of North Carolina.  In the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.  A photocopy of this signed Release shall be as effective as the original. This Release is binding on myself, my agents, heirs, assigns, and personal representatives. I acknowledge that I am 18 years old or more. If I am not at least 18 years old, I have marked through the preceding sentence, and I understand that my parent’s or guardian’s signature must appear below before I will be permitted to participate in the activity.
