Biden, President of the United StatesThe White House1600 Pennsylvania Avenue, NWWashington, DC20500United Statesof AmericaDearPresidentBiden:We write to you as U.S. military veterans who were injured (and their family members), and Gold Star familieswhose loved ones were killed,interrorist attacks orchestratedand committedby Iran’s Islamic Revolutionary Guard Corps (IRGC). Wehavegrave concernsover published reports that the Biden Administration isconsidering removing the IRGCfrom the State Department’s Foreign Terrorist Organization (FTO) list. In our view, removing the IRGC’s FTO designationwould threaten American lives, harm veterans and Gold Star families, and empower a terrorist organization that continues to sponsorand commitattacks against U.S. interests and alliesin the Middle East.As you know, according to the U.S. Government’s own reporting, the IRGC iscurrentlyengaged in active terrorist plots to kill former U.S. Government officials,and its terrorist proxies in Iraq and Syria have continued to attack U.S. forces andinterests in both countries over the past year. Therefore, rescinding the IRGC’s FTO designation would symbolicallygive the IRGC a green light to target Americans and attack our allies.Removing the IRGC’s designation would also damage the credibility of the U.S. designation process, which has been viewed as fact-based and apolitical for two generations. But FTO designations are not merely symbolic. Theyarealso the linchpin of most civil litigation aimed at deterring companies from providing assistance to the IRGC and other terrorist organizations.Rescinding the IRGC’s FTO designation will not onlywiden its access to resources and likely fuel increased terror activities;itmay also immunize the IRGC’s future aiders and abettors from heightened civil liability.Specifically, a decision to remove the IRGC from the FTO list would cause significantharm to the efforts ofveterans and Gold Starfamilies–like us –who are attempting to hold the IRGC and its aidersand abettors accountable for attacks on American citizens. Many veterans and Gold Star families have filedcivil lawsuits against Iran, the IRGC, and banks and companies that have criminally conspired with the IRGC’s agents to launder billions of dollars through the U.S. financial system. The IRGC’s FTO designation provides American victims of terrorism –including the Gold Star families of more than 600 U.S. soldiers murdered by the IRGC and Hezbollah in Iraq –with powerful evidenceas they pursue accountability for the attacks that wounded them or killed their family members. Moreover, under federallaw, anyonesubject to U.S. jurisdiction can be charged criminally if they knowingly provide material support to an FTO. An FTO designationalso brings far greater
