LA City News Tweets for 2/28/11 - L.A. Community College Scandal Will CONTINUE to UNFOLD in L.A. Times, City Hall has MOLES (besides rats) & MORE...

11PM LEGAL UPDATE: I've been back and forth on my interpretation on what the letter DOWD/DOGG received on Friday from the Federal judge means. MY FINAL INTERPRETATION is: CITY DEFAULTED. (Doesn't matter how they respond, at this point. It's like Rock, Paper, Scissors...and our "DEFAULT" entry trumps whatever they got. If WE turn in "DEFAULT" entry...it will cancel out whatever they turn in since they missed a deadline in 2009 that said, "judgment of default WILL be taken against you." (Not "may" or "can" be taken against you...WILL. AND...it IS!) In other words, my initial Sunday blog post opinion remains, unamended and un-updated.

REGARDING L.A. CITY HALL MOLES: The reason you are surrounded by them and the reason they keep me cranky with fresh new info on a daily basis (far more than I can process on the blog, unless Garcetti or City Attorney unleashes ZD's "blog fury-frenzy energy), is because the people all around people like Villaragiosa, Huizar, Garcetti, Greuel and elsewhere are sicken by what they see happening at the hands of their elected bosses. And when they can't stand the stench any longer...that's when ZD gets a call or email. AND IF YOU CHECK MY RECENT BLOGGING OVER THE PAST MONTH, SINCE YOU PISSED ME OFF AND UNLEASHED A ZD BLOG FURY-FRENZY, I THINK I HAVE PROVEN I CAN TAP THE INFO AND FUNNEL IT ONTO THE BLOG, AT WILL. Let's hope I can chill on that will for a little bit. A LOT OF DUST TO SETTLE...and to be honest...IT'S ALREADY BEEN EXPOSED FOR ALL INVESTIGATORS TO SEE. (So I feel pretty good about my civic duties.)

BREAKING NEWS: Did Carmen Trutanich's L.A. City Attorney Office DEFAULT on Zuma Dogg/Matt Dowd's 1st Amendment Lawsuit? (APPEARS AS THOUGH THEY DID!)

BREAKING NEWS:
As you know on October 21, 2010, the Honorable Judge Dean D. Pregerson issued an injunction against much of the illegal rules at Venice Beach regarding Ordinance 42.15 (boardwalk regulations and restrictions.)

Since then, DOWD/DOGG have been attempting to negotiate a settlement with the city for the five years of damages, both on the boardwalk; and inside council chambers during public comment.

As settlement talks broke down with the city, the only option was to file for summary judgment, which means the judge would give a ruling on the entire lawsuit.

So far, he only issued an injunction on the Venice boardwalk, but has not yet ruled on the "Code of Conduct" issues relating to the multiple 1st Amendment violations that occurred when Mr. Dowd and Mr. Dogg were ejected for various reasons under L.A. City Council President Eric Garcetti's "Code of Conduct' (and Council President Pro-Tems Jan Perry and Dennis Zine.)

So a summary judgment would have the judge rule on this "Code of Conduct" (and more importantly, it's enforcement "as applied" on DOWD/DOGG), since all the Venice stuff has already been ruled on with a court ordered injunction (on 10/21/10 as mentioned above.)

HOWEVER, on Friday, Mr.Dowd received a letter from the Honorable Judge Pregerson's court giving DOWD/DOGG until 3/11/11 to reply as to why the case shouldn't be dismissed.

The option DOWD/DOGG were given was to request an entry of "DEFAULT" against the city.

THIS MEANS CODE OF CONDUCT WILL AUTOMATICALLY LOSE BY DEFAULT. So that should change a few things during public comment. And damages will probably be a FUCK of a lot more, now.

LESSON: He who hesitates is lost. As in lost to Dowd/Dogg cause you took too much time and we caught you defaultin', y'all. WE HAVE WARNED YOU EVERY STEP OF THE WAY ABOUT THIS KARMA THING. I think you've learned. Sorry the master had to teach it to you. Good luck spinning this during your next election, Nuch! (Maybe Dowd should run AGAINST you. He just ran rings AROUND you.)

LOS ANGELES (CBS) — They oversee housing for some of LA’s neediest families.

But a CBS2 News investigation has found some LA housing commissioners living the good life on taxpayer money. Spending tens of thousands on fancy hotels and lavish restaurants. David Goldstein reports.

EXCERPTS FROM VIDEO REPORT ABOVE:

The Housing Authority of the City of LA manages 6500 public housing units like the ones here at Pico Gardens in East LA. Thousands of LA’s neediest families live here…many worried about putting a roof over their head or where their next meal will come from. But we’ve found some housing commissioners spend more on travel than some of these people will make in an entire year!

The commissioners oversee a billion dollars of taxpayer money, mostly from the federal government.

They’re appointed by the mayor. It’s a parttime job. They make no salary. Just $50 a meeting. And have to deal with an ever shrinking budget.

But we found they spent $158,000 over the past two years on travel and fine dining. Mostly attenting housing related conferences at swanky hotels.

We found receipts from the Ritz-Carlton in Washington, D.C., Miami Beach and Laguna Niguel.

A room here at the Ritz in Laguna certainly isn’t the Motel 6. According to this receipt, it cost taxpayers more than $400 a night. Nearly $2,000 for a four day conference attended by Commissioner Margarita Garr.

“The purpose of these conferences is to enhance our knowledge as commissioners.” [That's some cost/price to pay. I wonder how much community members feel your knowledge was enhanced. Maybe all the enhanced knowledge just wasn't put into action. Too busy feeding your face!]

We also obtained documents showing at least three commissioners received cash advances of hundreds of dollars in per diem on some trips to cover all meals while on the road. But then used Housing Authority credit cards for room service and restaurants. What’s called double dipping. [Not like the kind on the "Seinfeld" episode with potato chips and dip! Oh no...]

Including a $30 shrimp dinner. $25 salmon entree. We found it in the travel documents for Commissioner Alicia Maldonado. It shows she received $319.50 in per diem…then charged this $167.00 dinner for four people, including herself, to the Housing Authority credit card.

“Is that double dipping?”

“No, I don’t think so.” [YOU PAY FOR ALL THAT ENHANCED KNOWLEDGE THEN YOU DON'T EVEN KNOW WHAT THE MOST OBVIOUS DEFINITION OF DOUBLE DIPPING IS??? WOW, you have TERRIBLE judgment and must be plain dumb. HOW MUCH MONEY DO YOU OVERSEE? You are in charge of WHAT?]

She at first denied it. And then called it an oversight.

“You’re correct. It would have been better to pay with the cash I had in my hand.” [She must have gone to the "Jose Huizar's School of Deny Till Laughable."]

Documents also apparently show Commissioner Maria Del Angel did the same thing…getting a cash advance of $390.50 for a trip to Washington last September. Then charging a nearly $250.00 dinner for a group of people, including herself. [That group of people WAS herself!]

“You can’t get a per diem and then go to a restaurant and charge that can you?”

“Yes, no?”

“I guess you’re right on that.” [Maria Del Angel is still not sure. She only guesses he is right. WOW, she's in charge of WHAT? She has WHAT responsibility? I think your average LAUSD second grader could understand this more easily than Maria.]

And there were some great meals. We found this receipt for a $1,000 dinner in Washington, D.C. attended by several commissioners and others who were attending a convention. It was at Fogo de Chao, a chain of Brazilian steak houses with one in Beverly Hills…known for its 15 cuts of beef.

The receipt shows 12 people sat at the table…ordering 12 steak dinners for $49.50 a piece!

They also had 16 Caipirinhas, the Brazilian national cocktail. Made with a special rum.

$9.75 a drink!

According to Housing Authority policy, company credit cards cannot be used for alcoholic beverages.

“Do you know credit can’t be used for alcohol?”

“Yes.” [Well, at least now were getting somewhere!]

But three commissioners split the bill, including Commissioner Garr. And put it on their credit cards…after getting their cash advance.

“Who’s minding the store?”

Housing Authority President Rudolph Montiel said because of our investigation, he’s reassessing conference travel and looking into the allegations of double dipping. [Still hasn't taken a position...but is "reassessing!"]

“I think we will undertake a rigorous examination of these expenses and determine what if any expenses have to be reimbursed and then ask the commissioners to reimburse these monies.” [A "rigorous examination?" How about, "I can assure you this will not be happening anymore?" "If any?" You already have these people on camera admitting to this.]

We told the mayor who appointed the commissioners. He wants to see if all the $158,000 in taxpayer money was well spent.

“I want to know when it was used…how it was used.”

It comes as good news to residents of public housing —

“It’s ridiculous they get that kind of money.” [WOW, Antonio...you really sound authoritative and in charge! Dare I say, "Successful?"]

— who hope the money spent on good food and fancy hotels on the road can be put to better use at home.

Leaders of the Los Angeles Community College District decided to remake the nine campuses for the 21st century. They promised rigorous oversight of costs and quality. But a Times investigation found that tens of millions have gone to waste.

The trustees rely largely on contractors, college employees and unions to fund their election campaigns. Many political donors received contracts in the construction program. The searchable database shows the sources of political money and which donors have contracts.

Part 1 - The price of poor planning, weak oversight: A pattern of chaotic management, costly blunders and hiring of relatives emerges from interviews and thousands of pages of internal e-mails.

Part 2 - A failing grade for a new science complex: Crooked cabinet doors, faulty plumbing and a lack of temperature controls mar Valley College's health and science complex. Newly opened, it needed extensive repairs.

NBC INVESTIGATION: DWP OVERCHARGES CUSTOMERS - Department To Issue Refunds (Class Action Lawsuit To Be Filed By ZUMA DOGG!)

BREAKING NEWS: THIS IS HUGE! DWP WILL OWE UNCOUNTED MILLIONS TO CUSTOMERS...and watch how shady the refund process will be. That's why I am working on a class action lawsuit as you read this. IT WILL TAKE A CLASS ACTION LAWSUIT TO HAVE DWP REFUND THIS "TRASH COLLECTION FEE" MONEY BACK TO CUSTOMERS. An NBCLA investigation has exposed how the LADWP has been wrongly charging perhaps thousands of its customers for a service they don't even get. The utility has apparently been doing this for more than a decade.



"How long have I been paying for this? I've lived here for 10 years. This could add up to a lot of money," says Venice resident Tamara Henry, who recently noticed suspicious charges on her DWP bill.

Henry noticed she's been charged up to $50 per bill for a "solid resources fee."

That fee is for city trash collection. But her Venice apartment gets its trash picked up by a private firm.

The city isn't supposed to charge you that fee if you don't get city trash pickup.

Our investigation found numerous buildings, including condos and apartments, where residents are getting charged for city trash pickup they don't get.

"I felt ripped off," says Yuson Shin, after she realized she's been getting charged for city trash pickup on her DWP bills for more than 10 years, even though her building has always had private collection service.

Last year, she began calling the DWP to get a refund.

"It took a dozen calls or more. They made me jump through hoops," says Shin.

She says DWP officials told her to call the LA Bureau of Sanitation. She says Bureau officials then told her they'd need proof from her apartment manager that her building gets private trash pickup.

According to the management company, Howard Management, it provided that proof, and the city lost the documents.

Months later, Shin's DWP bill finally shows that she's owed a $1,400 credit.

Some customers think the city is intentionally making it hard to get refunds because it wants to keep the money it's over-billed.

"Just think about that little charge, multiplied by hundreds of thousands of people, how that will increase their bottom line," says DWP customer Tamara Henry.

NBCLA tried to ask the DWP why it's billing customers for city trash pickup they're not getting.

DWP representatives refused to talk, and told us to call the LA Bureau of Sanitation.

A Bureau spokesperson said the organization wouldn't comment. So we tracked down the director of the Bureau of Sanitation, Enrique Zaldivar, and asked him about the erroneous charges.

"It's a database problem," said Zaldivar, explaining that a computer problem is causing DWP customers to get billed for city trash service they don't get.

We asked him, "Whose database has the problem, yours or DWP's?"

"It's hard to say, really, it's hard to say. It's hard to say which one," Zaldivar replied.

He also said the city has no idea how many customers are getting wrongly charged.

But apparently, the bureaucrats have known about this billing rip-off for more than a decade.

In 1998, a class action lawsuit was filed against the City of LA for this exact same problem: billing customers for city trash pickup they didn't get.

Records show the city settled the suit in 2000. The lawyer for the class action plaintiffs tells NBCLA the Bureau of Sanitation had to refund thousands of customers as a result of the settlement.

The Bureau of Sanitation declined to speak with us about the prior lawsuit.

Now, more than a decade later, DWP customers are still getting wrongly charged.

"This is money I could be using for something else," says Henry, whose been calling the DWP to try and get her refund.

"I'm getting the runaround," says Henry.

The Bureau of Sanitation has begun sending out 750,000 letters to DWP customers, telling them that if they think they've been wrongly billed for city trash pickup, to call 1-800-773-CITY or 1-213-473-5663.

Don't forget, a few (at least) years ago, DWP lost a lawsuit in the CA Supreme Court that charged them with wrongly charging taxes on the electricity they supplied. I've never been repaid that tax money they illegally charged me. I've been following all your blogging on the Pension crisis. Unbelievable amount of info. you've put out. A Message for Barack Obama, Eric Holder & Jerry Brown on California Pension Fraud (With BILLIONS LOST TO FRAUD, SOMEONE NEEDS TO BE HELD ACCOUNTABLE!)

A small circle of private equity firms and the politicians they back and get elected into office are responsible for billions and billions of pension dollars disappearing into thin air.
It was announced at an L.A. City Council meeting that the City of L.A. was invested in overly-risky, non-investment grade "alternative investments" (with emphasis on real estate). The result was a loss of -21% of the pension fund for the '08 & '09 period.

I believe the same illegal racketeering and fraud that Andrew Cuomo busted people for in New York, has also been applied, here in California.

I know you are friends and colleagues with a lot of the people responsible, but I hope you can bring yourself to see that at least some of these people are brought to justice, in hopes of shutting this pension-pilfer fraud ring down.

The City of L.A. sends out undercover sting operations to try and bust people selling a pack of one dollar incense at Venice Beach. They will write you a criminal ticket for standing in the wrong spot on the Venice Beach boardwalk:


MEANWHILE, these same people are responsible for billions and billions of taxpayers dollars being lost in a fraud and abuse scheme that Cuomo detailed in his investigation and I have posted on my blog.

The entire city and entire State of California is suffering a state of budget and services emergency over this single issue.
I also heard you are trying to "shut down" the community redevelopment agencies (like CRA/LA) -- and this may be a tact you can use to do so. Pension money is being funneled into these projects in a cahoots-racketeering scheme. Shut down pension fraud, and you shut down the CRA.
